5D Inflatable & Entertainment LLC Rental Agreement
This rental agreement is entered into between Renter Name and 5D Inflatables & Entertainment LLC on Date. The Customer hereby agrees to rent from 5D Inflatables & Entertainment LLC, a Product and related equipment as specified below. If a signed rental agreement is not received within 7 days of delivery, rental date or product may not be guaranteed.
Rental Period: The 24 hour rental period shall begin at time of delivery, between 8AM and noon on start date and end at 24 hours after delivery on end date, between 8AM and noon. If specific times are required, please notify us as soon as possible.
Rental Location: The Equipment shall be used only at the location, address, as specified in this rental agreement. The Customer shall provide a safe and level surface for the Bounce House/Inflatable and ensure that the area is free of any obstacles or hazards. Best conditions are on a flat, grassy area free of debris, such as rocks, branches and other sharp objects. Inflatables can be placed on a clean flat driveway, if specified ahead of arrival time/date. Customer is responsible for identifying cable and power lines to avoid before installation of bounce house anchors. Any residence over 30 miles from the business address is subjective to a mileage fee.
Cleanliness: No food, drinks, candy, water, glitter or sharp objects are allowed in the bounce house at any time. See full list of rules located on the outside of the bounce structure. Excessive cleaning fee may be applied if the inflatable structure(s) are excessively dirty and require extra procedures.
Equipment Use: The Customer shall use the Equipment [extension cords, blower and tarps] only for its intended purpose and shall not modify or alter the equipment in any way. The Customer shall not allow anyone to use the Equipment who is not physically capable of using it safely. Inflatable tents are to be used for the purposes as intended, as a housing structure, not as a bounce house. Inflatable Tents are not weather and waterproof. Renter is responsible for equipment from time of possession to time of pick up. The equipment shall be in the same condition as received. The Customer shall ensure that all users of the equipment follow all safety guidelines and instructions provided by 5D Inflatables & Entertainment LLC. Customer is responsible for providing a power source to inflatables. A generator may be provided for inflatable rentals at an extra cost, when pre arranged. The generator shall only be used for 5D inflatable purchases and must remain with the bounce house at the agreed location. 5D Inflatables & Entertainment LLC will only provide one full tank of gas for the generator and it must be shut off, when not in use.
Equipment Failure: You agree to immediately discontinue the use of rented items should it at any time become unsafe or in a state of disrepair, and will immediately (one hour or less) notify 5D Inflatables & Entertainment LLC. 5D Inflatables & Entertainment LLC agrees at our discretion to make the items operable in a reasonable time, or provide a like item if available, or make a like item available at another time, or adjust rental charges, the provision does not relieve renter from obligations of contract. In all events 5D Inflatables & Entertainment LLC shall not be responsible for injury or damage resulting in failure or defect of rented item.
Payment: The Customer shall pay 5D Inflatables & Entertainment LLC the full rental fee of total cost at the time of delivery. A deposit of deposit amount is required at the time of booking, which will be taken off the remaining rental balance. Final payment is due, upon delivery, prior to set up. Customer agrees to saving credit card info on file. Your credit card will be charged only with the amount agreed upon, 5D Inflatables & Entertainment LLC will not have access to full credit card information. Final payments can be received in the form of cash, check or debit card. Anything over 20 miles from the business address is subject to a mileage fee, starting at a $25 delivery fee. Total miles not to exceed 30. Please note a surcharge will be applied to all Credit Card payments.
Liability: The Customer assumes all responsibility for any injuries or damages caused by the use of the equipment, and agrees to indemnify and hold harmless 5D Inflatables & Entertainment LLC from any and all claims, damages, or injuries arising out of the use of the equipment and rentals. If items are lost, stolen, damaged, renter will assume cost of replacement or repair, including labor costs. The Customer acknowledges that the equipment may be dangerous and that there are inherent risks associated with its use.
Cancellation: The Customer may cancel the rental agreement at any time prior to the rental date. If the Customer cancels the rental agreement less than 3 days before the rental date, 5D Inflatables & Entertainment LLC may retain the deposit.
Weather Conditions: 5D Inflatables & Entertainment LLC has the right to postpone/reschedule booking, at no cost to the renter, if sustained wind speeds exceed greater than 20 mph or weather conditions are not conducive to safe usage of the rented inflatable products. Agreement shall be upheld at a later predetermined date, at no extra cost to renter.
Live fire: The Customer is restricted from using any electric heating element, heat lamps or live fire within 20 feet of the rented inflatable structure. Burn damage to rented products will be the full responsibility of the customer.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois. Any legal action arising out of this Agreement shall be brought in the courts of Kane, Illinois.
Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications and proposals, whether oral or written. This Agreement may not be amended except in writing signed by both parties.
Customer agrees to read 5D Inflatables & Entertainment LLC’s Safety Rules, before the rental date.
